This privacy policy notice is for the Labii Service, and governs the privacy of those who use it. The purpose of this policy is to explain to you how we control, process, handle and protect your personal information while browsing or using this Service, including your rights under current laws and regulations. If you do not agree to the following policy, you may wish to cease viewing / using this application.

The Service is owned and operated by Labii Inc. a software company that develops and distributes Electronic Lab Notebook (ELN) and Laboratory Information Management System (LIMS) ("Service").

This privacy policy describes the types of information we may collect from you or that you may provide when you use our Service in general, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

With respect to applicable laws, this privacy policy also will alert you to any particular and additional information and rights you have pursuant to the General Data Protection Regulation effective 25 May 2018 ("GDPR") that are applicable to information that Labii may collect from you (or "Personal Data" under GDPR) if you are located in the European Union GDPR. Under GDPR you are defined as a "Data Subject" and Labii is a "Data Controller" for Personal Data that Labii obtains and "Processes" pursuant to this policy.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your only recourse is not to use our Services. By accessing or using the Services, you agree to this privacy policy.

GDPR Lawful Bases for Processing Personal Data of Data Subjects

Under GDPR, Labii may only Process the Personal Data of a Data Subject lawfully if Labii has at least one of six lawful bases for processing the Personal Data. Currently under this version of the privacy policy, Labii relies on at least one of the following legal bases to process Personal Data under GDPR:

  • In order to perform pursuant to one or more legal agreements (contracts) with you,
  • With your consent, and
  • Pursuant to a Legitimate Interest, in which Labii considers the purpose it has for processing your Personal Data, whether the Processing is necessary for that Purpose, and whether your own personal interests as a Data Subject outweigh Labii’s purpose in processing your Personal Data.
(GDPR does not apply to you if you are not a Data Subject providing your Personal Data to Labii from within the European Union.)

Gathering of Personally-Identifying Information

Certain visitors to Labii's website choose to interact with Labii in ways that require Labii to gather personally-identifying information. The amount and type of information we collect depends on the nature of the interaction. For instance, we require visitors who sign up for an account at Labii.com to provide an email address. You are required to provide additional information when you engage in transactions with Labii, including personal and financial information required to process those transactions. In each case, Labii collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor's interaction with Labii. We do not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Aggregated Statistics

We may collect statistics about the behavior of visitors to our website. Though we may display this information publicly or provide it to others, Labii does not disclose personally-identifying information other than as described below.

How do we use your information?

When you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features, we use information that we collect about you or that you provide to us, including any personal information in the following ways:
  • To personalize your experience and to allow us to deliver the type of content and product offerings in which you are most interested.

Protection of Certain Personally-Identifying Information

Labii discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Labii's behalf or to provide services available at Labii's websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Labii's websites, you consent to the transfer of such information to them. Labii will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Labii discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Labii believes in good faith that disclosure is reasonably necessary to protect the property or rights of Labii, third parties or the public at large. If you are a registered user of the Labii website and have supplied your email address, Labii may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what's going on with Labii and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Labii takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

Cookies are small text files that may be placed and stored on your computer/device allowing internet access when you visit Labii website. Cookies help us identify and track visitors, their usage of Labii's website, and their website access preferences. Labii visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Labii's website, with the drawback that certain features of Labii's websites may not function properly without the aid of cookies.

Third-party disclosure

We do not share, sell, trade, or otherwise transfer to third-parties your Personally Identifiable Information.

We do not include or offer third-party products or services on our website. In future however, users may find advertising or other content on our Service that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. For those users of our Services from within the European Union and for which GDPR applies, we have created the following mechanisms and practices to provide you with the following control over your personal information that comprises GDPR Personal Data:

What are your rights?

By law, if any of your personal information/Personal Data provided to Labii is subject to GDPR in the European Union, you have a number of rights when it comes to your personal information/Personal Data. Further information and advice about your rights can be obtained from the data protection regulator in your country.

IMPORTANT: When you contact Labii to exercise your rights described below, it is very important for security verification and other purposes that you use any email address that you know is associated with the personal information/Personal Data about which you are contacting Labii

1. The right to object to processing

You have the right to object to certain types of processing, including processing for direct marketing (i.e. if you no longer want to be contacted with potential opportunities).

2. The right to be informed

You have the right to be provided with clear, transparent, and easily understandable information about how we use your Personal Data and your rights. This is why we are providing you with the information in this privacy policy and also are available if you want information that you do not believe this privacy policy provides.

3. The right of access

You have the right to obtain access to your Personal Data (if we are processing it), and certain other information about or privacy practices with respect to your Personal Data (similar to that provided in this privacy policy).

This is so you are aware and can check that we are using your information in accordance with GDPR or any other applicable data protection laws.

4. The right to rectification

You are entitled to have your information corrected if it is inaccurate or incomplete.

5. The right to erasure

This is also known as "the right to be forgotten" and, in simple terms, enables you to request the deletion or removal of your personal information/Personal Data where there’s no compelling reason for us to keep using it. This is not a general right to erasure; there are exceptions.

(NOTE: Consistent with GDPR, Labii may retain a trivial amount of information to keep a record of its compliance with your request.)

6. The right to restrict processing

You have rights to "block" or suppress further use of your personal information/Personal Data that Labii processes. When processing is restricted, we can still store your personal information/Personal Data, but may not use it further. We keep lists of people who have asked for further use of their information to be "blocked" to make sure the restriction is respected in future.

For clarity, if you do make these requests, it does not mean that anything we have done with your personal information/Personal Data with your consent up to that point is unlawful.

7. The right to data portability

You have rights to obtain and reuse your personal information/Personal Data for your own purposes across different services. For example, if you decide to switch to a new provider of services like the Services from Labii that you subscribed to, this enables you to move, copy, or transfer your personal information/Personal Data easily between our IT systems and theirs safely and securely, without affecting its usability.

(NOTE: Labii will retain and continue to process your personal information/Personal Data unless you also request to be forgotten or request restricted or blocked processing.)

8. The right to lodge a complaint

You have the right to lodge a complaint about the way we handle or process your personal information/Personal Data with your national data protection regulator. However, we hope you will contact us first so can try to address your complaint directly.

9. The right to withdraw consent

If you have given your consent to anything we do with your personal information/Personal Data, you have the right to withdraw your consent at any time. This includes your right to withdraw consent to us using your personal information/Personal Data for marketing purposes.

Labii’s Retention of Personal Data Under GDPR and Other Applicable Laws

We only retain your personal information/Personal Data for as long as is necessary for us to use your information as described above or to comply with our legal obligations and legitimate interests. Please be advised that this means that we may retain some of your personal information/Personal Data after you cease to use our Services. For instance, we may retain your data as necessary to meet our legal obligations, such as for tax and accounting purposes.

When determining the relevant period in which we retain or establish/revise periods for retaining personal information/Personal Data, we will take the following factors into account:
  • Our contractual obligations and rights in relation to the information involved;
  • Legal obligation(s) under applicable law to retain data for a certain period of time or with respect to pending or anticipated legal actions;
  • Our legitimate interest where we weigh your interest in controlling your Personal Data and against our lawful purpose in processing your Personal Data;
  • Statutes of limitations under applicable law(s);
  • If you have made a request to have your information deleted; and
  • Guidelines issued by relevant data protection authorities.

Otherwise, pursuant to GDPR, we will securely erase your personal information/Personal Data once there is no lawful basis or legal obligation to store or process it.

Your Rights Under California Privacy Statutes

California Civil Code Section § 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Business Transfers

If Labii, or substantially all of its assets, were acquired, or in the unlikely event that Labii goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Labii may continue to use your personal information as set forth in this policy.

Privacy Policy Changes

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account and/or possibly through a notice on the applications’ home page. The date the privacy policy was last revised is identified at the bottom of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically using our Services and this privacy policy to check for any changes. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

We do not specifically market to children under the age of 13 years old.
